On May 1, 2020 an altercation in Old Town State Park in San Diego led to a fateful police encounter that ended with the death of 36-year-old Nicholas Bils. The man who shot him deputy Aaron Russell has since resigned from the San Diego County Sheriff Department and pleaded guilty to voluntary manslaughter. Russell was sentenced to probation with a suspended three-year prison sentence and one year in county jail. However the former deputy case continues to highlight critical issues around police use of force, public safety and the struggle to balance civil liberties with law and order. From Park Disturbance to Police Custody

The events leading to Bils death began that morning in Old Town State Park. Bils was reportedly brandishing a golf club prompting calls to park rangers. When rangers responded Bils allegedly threw rocks at them before running off. He was soon located by police and arrested for assaulting the rangers. In custody the San Diego man grew increasingly erratic.

Despite having no knowledge of Bils background or alleged offenses Russell fired five shots at the fleeing man. At least four bullets struck Bils with one piercing his back causing a fatal injury. Out of over a dozen officers present, Russell was the only one who discharged his firearm and his actions quickly came under scrutiny.

A Mentally Ill Man in Distress

Following his death Bils family detailed his lengthy history of severe mental illness including a diagnosis of paranoid schizophrenia. His mother Kathleen Bils believes his phobia of police and authority figures contributed to his attempt to flee from the patrol vehicle.

In his confused state Bils likely felt that running into a crowd of law enforcement officers was a safer option than remaining confined. Tragically this decision cost him his life once Deputy Russell intervened.

Investigations, Lawsuits, and Charge

Authorities in San Diego promptly opened administrative and criminal investigations into Russell’s actions. Shortly after the shooting, he submitted his resignation from the department and was later accused of second-degree murder. Russell did, however, ultimately enter a voluntary manslaughter plea. He was given a sentence in February 2022 that included one year in county jail, three years of probation, and a suspended three-year prison term.

The Bils family also filed a federal civil rights lawsuit against San Diego County and Russell in addition to the criminal charges, which was settled in 2022 for $8.1 million.
